Definition OF THE PRESCRIBED SCOPE of agricultural land for FACILITIES

According to the Notice on the Management of Land used for facility Agriculture jointly issued by the Ministry of Natural Resources and the Ministry of Agriculture and Rural Affairs in December 2019 (hereinafter referred to as the Notice), land used for facility agriculture includes land directly used for crop cultivation and livestock, poultry and aquaculture in agricultural production. Among them, land for crop planting facilities includes housing for crop production and serving production, storage places for agricultural materials and machinery and tools, and land for facilities directly related to production, such as drying and airing, sorting and packaging, and preservation and storage. Land for livestock and poultry aquaculture facilities includes land for breeding production and directly related facilities such as manure disposal, inspection and quarantine, excluding land for slaughtering and meat processing facilities.

The BALANCE OF OCCUPATION AND compensation OF agricultural land FOR FACILITIES

In the Notice, the facility agriculture belongs to the internal structure adjustment of agriculture, and the general arable land can be used, and the balance of occupation and subsidy need not be implemented. If the planting facilities do not damage the cultivated land level, permanent basic farmland may be used, and no additional zoning is required. If the cultivated land layer is destroyed but the permanent basic farmland is difficult to avoid due to the location, the permanent basic farmland can be used but must be redelimited. In principle, breeding facilities shall not use permanent basic farmland. If a small amount of permanent basic farmland is involved, it is really difficult to avoid, it can be used but must be delimited.

Land used for facility agriculture that is no longer in use must be restored to its original use. If THE LAND USED FOR facility AGRICULTURE IS OCCUPIED by NON-agricultural construction, THE examination and approval procedures for construction land shall be handled according to law, and if the land is classified as cultivated land, the balance of occupation and subsidy shall be implemented.

The PRESCRIBED scale of LAND USED FOR AGRICULTURAL FACILITIES

According to the Circular, the scale of land used for agricultural facilities of various types shall be reasonably determined by the natural resources administrative departments of all provinces (autonomous regions and municipalities directly under the central government) together with the agricultural and rural administrative departments according to the production scale and construction standards. Among them, the nursing house implements the special cleaning and rectification standards of the "greenhouse house" problem, and breeding facilities allow the construction of multi-storey buildings.

Administration OF LAND PRESCRIBED FOR AGRICULTURAL LAND FOR FACILITIES

In the Notice, it is stipulated that the relevant departments of various localities shall carry out daily management of the land used for facility agriculture, and the municipal and county natural resources administrative departments shall be responsible for the daily management of the land used for facility agriculture together with the agricultural and rural administrative departments. National and provincial natural resources authorities and agricultural and rural authorities are responsible for supervising and controlling the land used for facility agriculture by various technical means. The land used for facility agriculture shall be put on record by the rural collective economic organizations or operators to the township governments, which shall regularly collect the information and then submit it to the county-level natural resources administrative departments. If permanent basic farmland is to be rezoned, the county must be approved by the county natural resources authority before construction can begin.
